Terms and conditions

1. Entry into this competition is deemed acceptance of these and any other applicable terms and conditions.

   Promoter

2. The Promoter of this competition is Foodstuffs (N.Z.) Limited (Foodstuffs).

   Promotion Period and how to enter

3. The competition commences on [26/06/2023] and runs until close of trade on [09/07/2023] (Promotion Period).

   Eligible Entry

4. To enter the competition, you must make a transaction at a South Island Four Square store during the Promotion Period for over $20 in value, excluding tobacco products, gift cards, or Lotto tickets (Eligible Entry). You will receive a maximum of 1 entry code per transaction which can be used to enter the competition online at 99th Birthday Giveaway | Four Square.

    

5. Incomplete or invalid entries or those not submitted in accordance with the entry instructions will not be accepted. The Promoter accepts no responsibility for late, lost, or misdirected entries.

    

6. You may submit multiple unique Eligible Entries to this competition.

   Eligibility to enter and to win a prize

7. To be eligible to enter this competition and win a prize:
   1. you cannot be a Four Square or Foodstuffs staff member;
   2. you must make an Eligible Entry;
   3. you must be 18 years of age or older;
   4. you must live in New Zealand;
8. If you are unable to satisfy any of the requirements in clauses 7(a)-(c) and you submit an entry to the competition, you will be ineligible to win a prize.

    

   How winners will be selected

9. The prize winners will be drawn by Foodstuffs on Tuesday 18/07/2023 by random electronic selection from all Eligible Entries. The first Eligible Entry drawn for each South Island Four Square store will win a $99 Four Square Gift Voucher. One Eligible Entry drawn across all South Island Four Square stores will win $9999 in Four Square vouchers. (Prize).

    

   Notifying winners

10. The winner will be notified by Foodstuffs or its agent within 10 working days of the draw, via the contact details provided with the entry to the competition. In the event that the winner cannot be contacted within 15 working days of the draw occurring or if Foodstuffs determines that the winner is not eligible to participate in a draw, the prize will be forfeited. A further draw will then be conducted and the prize allocated to the new winner, on these Terms and Conditions.

     

11. Foodstuffs is not responsible if a winner cannot be contacted following the draw due to incorrect or out of date contact details being recorded in their entry, and any such winner will forfeit the prize to the next eligible winner, on these Terms and Conditions.

     

    Prize conditions

12. The Prize is not transferable, exchangeable, or negotiable and is not redeemable for cash.

     

13. The Prize must be redeemed within twelve months of the prize being drawn. If the Prize is not redeemed by this date, it will be forfeited by the winner.

     

14. The Prize must be collected from a South Island Four Square store if a winner lives in the South Island, or the Prize will be couriered to a winner that lives in the North Island.

    Verifying compliance with these terms

15. Foodstuffs reserves the right to verify the identity of any entrant (including an entrant's, age, city/town of residence), to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions. 

    Exclusion of liability

     

16. Subject to any applicable laws which cannot be excluded, Foodstuffs, any participating store, their respective employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this competition or with winning, redeeming or benefiting from the prize.

     

    Disputes

17. In the event of a dispute concerning any aspect of the competition including eligibility the decision of Foodstuffs will be final.No correspondence concerning any decision made by Foodstuffs will be entered into.

     

    Amendment of terms

18. Foodstuffs reserves the right to amend, suspend or terminate the competition and these Terms and Conditions at any time and at its sole discretion

     

    Privacy

     

19. All entries remain the property of Foodstuffs.Your personal information may be used to conduct this competition and for future promotional and publicity purposes in relation to this competition.By entering this competition you consent to the use of your personal information for these purposes. Four Square Privacy Policy will apply to all personal information that we collect from you.
