Promoter
1. Foodstuffs North Island Limited is the Promoter (Promoter) of the Four Square Summer Spin to Win Promotion (Promotion).
2. By participating in this Promotion you agree to these terms and conditions.
Participating Stores
3. The Promotion is being run at all Four Square stores in the North Island (Participating Stores).
Promotion Period
4. The Promotion runs from 12.01am 11 January 2021 – 11.59pm 7 February 2021 or while game ticket stocks last in each Participating Store, whichever occurs earliest (Promotion Period).
Qualifying Purchases and Game Tickets
5. Spend on purchases instore at Participating Stores, other than spend on, Gift Cards, prepaid debit cards, travel card top ups, phone card top ups, tobacco products and New Zealand Lotteries tickets, at any Participating Store in a single transaction during the Promotion Period qualifies for this Promotion (Qualifying Purchase).
6. During the Promotion Period:
a. you will receive one (1) game ticket with a unique entry code for each multiple of $25 spent per Qualifying Purchase per single transaction; and
b. subject to clause 7, should the Qualifying Purchase exceed $25, you will receive an additional game ticket for every additional $25 spent in that transaction.
7. A maximum of ten (10) game tickets can be attained in a single transaction. For example a shop with a Qualifying Purchase totalling $109 would receive 4 game tickets (1 per $25 spent). A shop with a Qualifying Purchase totalling $289 would qualify to receive 11 game tickets (1 per $25 spent) based on the actual shop but in practice would receive the maximum 10 game tickets.
8. The game tickets can only be obtained at checkouts at the time of a Qualifying Purchase or from the customer service station when using the self-checkout after a Qualifying Purchase.
How to Play
9. Each game ticket will have a unique code and a barcode. To play, visit www.summerspin.co.nz . Each time you visit the promotional game site, you will need to enter your landline or mobile phone number and email address in the allocated fields and then enter the unique code on your game ticket. As soon as the unique code is validated, you will be prompted to click the "Play Spin to Win Now" button which will take you to the game play page where you will receive one game play.
10. To start the game, you simply use your mouse or finger (touch screens) to click and start the wheel spinning and then wait and see which one (1) of the nine (9) segments of the wheel aligns and is pointed to by the arrow at the top of the wheel once it has stopped spinning and come to a complete rest. The outcome of each game play is determined by the message on the segment indicated. The segment message will indicate you are either a winner of one (1) of three (3) levels of instant cash prizes or have gained entry into one (1) of the six (6) Ultimate Summer Prize Draws (Ultimate Prize Draws).
11. Game plays that result in the prize wheel landing on an instant cash prize segment win the cash prize value indicated. Winners will be advised on screen immediately and that they have been emailed a link to follow to complete a Prize Claim Form.
12. All participants whose game play spins do not result in an instant cash prize will receive automatic entry into one of the six (6) Ultimate Prize Draws, specifically the Ultimate Prize Draw indicated as the outcome by the prize wheel arrow for each game play.
13. After each game play, you will be prompted to enter another unique code and play again or log out of your session.
14. Retain all original receipts and Game Tickets: Entrants must retain their purchase receipt(s) and game tickets for all game plays throughout the Promotion Period as proof of all purchases. The Promoter retains the right to request receipts and/or game tickets to validate each and every instant prize claim. This includes the right to also request proof of all purchases for previous non-instant winning game plays. Failure to produce the receipt or game ticket for all entries when requested may, in the absolute discretion of the Promoter or its agents, result in invalidation of all of an entrant’s entries and forfeiture of any right to any instant or Ultimate Prize Draw prize. Purchase receipt(s) must clearly specify the Four Square store of purchase and that the purchase was made during the Promotion Period but prior to any instant prize claim.
15. Entry Limit: A maximum of four (4) entries per person per day is permitted, subject to the following:
a. Only one (1) entry permitted per $25 Qualifying Purchase.
b. Each entry must be submitted separately and in accordance with entry requirements.
16. N.B. The prize wheel stops and settles upon a segment randomly, the speed at which it spins cannot be altered with your mouse or finger depending upon how "softly or hard" you press the "Click to Spin" button to start the wheel spinning.
17. For the sake of clarity, after playing the “Summer Spin to Win” online game, the result, whether an instant cash prize or entry into an Ultimate Prize Draw, is pre-determined by the unique code entered and the algorithm driving the game wheel i.e. winning is based on chance and not the application of skill. The odds of winning instant cash prizes do NOT relate to the number of prize segments making up the spinning prize wheel. The wheel is an illustration only.
Instant Cash Prizes
18. The following instant cash prizes totalling up to NZD $250,000 are available to be won (each an Instant Cash Prize):
a. 3450 x $ 40
b. 200 x $ 400
c. 8 x $4000
Please note that at the time you enter the Promotion some prizes may have already been won.
19. Each Instant Cash Prize will be paid by the Promoter or its agent to each winner via direct transfer into the nominated winner’s bank account, subject to verification. Winners are to allow up to 28 working days to receive their prize via bank transfer, following validation of their prize claim.
20. Entrants Instant Cash Prize Winner Notification: As per clause 11, entrants will be notified immediately in writing on screen whether or not they have won an Instant Cash Prize. Instant Cash Prize winners will be emailed a link to be directed to the prize claim page online where they will be required to upload proof of purchase receipt(s) and provide all other necessary contact details including but not limited to Name, Address and Bank Account Number for the Promoter and its agents to validate their claim and then process payment of their prize.
21. All claims for Instant Cash Prizes must be made online immediately following a Summer Spin to Win instant prize win and, failing that, no later than 11.59pm on 7 February, 2021. After this time any unactioned Instant Cash Prize Claims become null and void.
Ultimate Summer Prizes
22. Entrants who do not win an Instant Cash Prize will instead automatically receive one (1) entry, per game ticket unique entry, into one of the six (6) Ultimate Prize Draws as more particularly described in clause 23 (Ultimate Prize Draws).
23. There are a total of twenty (20) Ultimate Summer Prizes to be won, two (2) of each to be won in Ultimate Prize Draws 1 through 5 and ten (10) of each to be won in Ultimate Prize Draw 6. Ultimate Summer Prize Winners will be drawn on 19 February 2021 by random electronic selection from all valid entries received. The winners of each Ultimate Summer Prize will be drawn from the specific Ultimate Prize Draw database of valid entries that entrants receive automatic entry into when participating in the Summer Spin to Win game.
24. The first two (2) eligible entries drawn in each of Ultimate Prize Draws 1 through to 5 will win one of the following prize packages:

26. All Ultimate Summer Prize Winners are to allow up to 28 working days to receive their prize, following validation of their entry and/or entries eligibility.
27. Winners can only be awarded one prize. If a winner is drawn for any additional prize, the prize will be forfeited, a further draw will be conducted and the prize allocated to the new winner.
Notifying Ultimate Prize Draw Winners
28. All Ultimate Summer Prize Winners will be notified by the Promoter or its agent within 10 working days of the draws being made, via the contact details on record for each winner by call to the phone number entered when registering to participate in the Summer Spin to Win promotion. In the event that any Ultimate Summer Prize Winner cannot be contacted within 14 working days of the Ultimate Prize Draws occurring or if the Promoter determines that a Ultimate Summer Prize Winner is not eligible to participate in one or more of the Ultimate Prize Draws, the prize will be forfeited, a further draw will be conducted and the prize allocated to the new Ultimate Summer Prize Winner.
29. The Promoter is not responsible if an Ultimate Prize Draw prize winner cannot be contacted following the draws due to incorrect or out of date contact details entered when playing a game ticket and any such winner will forfeit the prize to the next eligible winner, on these Terms and Conditions.
Eligibility to Enter and to Win a Prize
30. To be eligible to win an Instant Cash Prize or an Ultimate Summer Prize:
a. You cannot be an employee of a Participating Store;
b. You must have made a Qualifying Purchase;
c. You must retain a valid receipt of your Qualifying Purchase;
d. You must retain your original game ticket;
e. You must be a New Zealand resident and 18 years of age or older;
f. You must have a valid landline or mobile phone number, email address and New Zealand bank account number and entered these correctly; and
g. You must consent to the Promoter using your name, photo, hometown and image for publicity and promotional purposes (including the display of your name in store) and you must make yourself available for publicity photographs relating to the competition on request for no additional compensation.
31. The Promoter accepts no responsibility for lost game tickets.
32. Game tickets and Ultimate Summer Prizes are not negotiable or transferable. Ultimate Summer Prizes are not redeemable for cash. If any part or whole of an Ultimate Summer Prize package is unavailable for whatever reason, the Promoter reserves the right to substitute the item or package with similar goods of the same or greater value at its sole discretion.
33. The Promoter reserves the right to modify, suspend or terminate this Promotion at any time.
34. The game tickets must not be exchanged or on-sold.
Verifying Compliance with these Terms
35. The Promoter and/or its agents reserves the right, at any time, to verify the identity of any entrant (including an entrant's identity, age, city/town of residence and place of employment) and to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner calculated to jeopardise fair and proper conduct of the Promotion, or otherwise than in accordance with these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any or its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
36. Any cost associated with accessing www.summerspin.co.nz is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Exclusion of Liability
37. Subject to any applicable laws which cannot be excluded, the Promoter and each Participating Store, their respective employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this Promotion.
Disputes
38. In the event of a dispute concerning any aspect of the promotion the decision of the Promoter and its agents will be final. No correspondence concerning any decision made by the Promoter or its agents will be entered into.
Privacy
39. All entries remain the property of the Promoter. Your personal information may be used to conduct this competition and for future promotional and publicity purposes in relation to this competition. By entering this competition you consent to the use of your personal information for these purposes. Foodstuffs’ Four Square Privacy Policy will apply to all personal information that we collect from you.
